This website is operated by Grafko-Caspar d.o.o. ("we", "us", or "Caspar"). These Terms of Use (the "Agreement") govern your use of our website (casparcreate.­com) and all services available through it (collectively, the "Service"). By accessing or using this Site, you confirm that youhave read, understood, and agreed to these Terms. If you do not agree with any part of this Agreement, please do not use our Site.

This Agreement also includes any additional policies posted on our website, including but not limited to our Shipping Policy, Returns Policy, Privacy Policy, and Cookie Policy. These may be updated from time to time, and continued use of the Site means you accept any changes.

By registering an account with us, you enter into a contract governed by these Terms. Users who create a wholesale account are considered "business users" and not "consumers" under applicable regulations.

The Service includes (but is not limited to):

  • The ability to upload your own digital designs or images to our Site

  • Ordering custom-made products using those uploaded designs

  • Receiving updates, order details, and product information from us

You may only use our website and services if you are at least 18 years old. If you are under 18, you may only use our services with the involvement and consent of a parent or legal guardian.

These Terms apply to all visitors, users, and others who access or use the Service.

1. Use of the Website

You may use our Site for lawful purposes only. You agree not to:

  • Violate any applicable laws or regulations

  • Attempt to gain unauthorized access to our systems

  • Use our website for any fraudulent, harmful, or abusive purpose

  • Copy or reproduce any content or images without permission

We reserve the right to restrict or terminate your access to the Site at any time, without notice, if we believe you have violated these terms.

2. Intellectual Property

All content on this website, including text, graphics, product designs, images, logos, and layout, is the property of Grafko–Caspar d.o.o. or its licensors and is protected by copyright and other intellectual property laws.

You may not reproduce, modify, distribute, or use our content without our prior written consent.

3. Product Information

We strive to display accurate information about our products and services, but we do not guarantee that all descriptions, pricing, availability, or visuals are completely error-free. We reserve the right to correct any errors, update product information, or change prices at any time without prior notice.

Custom designs uploaded by users are their own responsibility. By uploading files, you confirm that you have the legal right to use and reproduce the content.

4. Orders and Payments

By placing an order through our Site, you agree to provide accurate, complete, and current information, including (but not limited to) your name, billing and shipping address, email address, phone number, payment details, and any files or customizations required for production.

We are not responsible for delays or errors resulting from incorrect or incomplete information provided at checkout.

Once you place an order, it will not be considered accepted until you receive an official confirmation from us via email. We reserve the right to accept or reject any order at our sole discretion.

In cases where an order is not accepted, we may, at our discretion, issue a full or partial refund. However, we reserve the right to charge the full amount if production has already started or if custom products have been prepared.

All payments must be made in full at the time of purchase using the available payment methods. Orders will not be processed or dispatched until payment is confirmed.

5. Pricing, Offers, and Discounts

All product prices are listed in the currency shown on our website and are subject to change at any time at our sole discretion. Any such changes will be reflected on the website and do not affect confirmed orders.

Shipping costs are calculated and displayed separately during checkout.

If you request changes to an order after it has been placed, additional charges may apply. We will contact you via email or phone to confirm the changes and arrange payment before proceeding.

From time to time, we may offer promotional discounts or publish offer codes. These codes:

  • Are valid only for orders placed through this website

  • May provide a discount or a free item, as described in the promotion

  • Cannot be combined - only one code may be used per order

  • Do not apply to shipping costs unless otherwise stated

  • May be subject to additional terms and conditions published alongside the promotion

We reserve the right to withdraw or change any offer without notice. Please note, promotional discounts or codes cannot be applied retroactively. Ensure all discounts are added at the time of purchase.

6. Changes to Orders and Cancellations

We start production within 30 minutes of receiving your order. During this time, you may contact us to request changes or cancel your order for a full refund via live chat or email.

After production begins (after 30 minutes), no changes or cancellations are possible without a charge. Cancellations after this point will incur a mandatory fee of 20% of the order value due to costs incurred for materials and labor.

We may contact you for order confirmations or clarifications before production. Failure to respond promptly may delay your order, but we are not obligated to contact you during production.

7. User Content and Image Uploads

By uploading images, designs, or other content to our website, you agree to the following:

  • You confirm that you own all rights to the content or have obtained proper permission from the rights holder.

  • You grant us a non-exclusive, royalty-free license to use the content solely for the purpose of producing and delivering your custom products.

  • We may display, edit, print, transmit, store, or delete any content as necessary to provide our services or as required by law.

  • You accept that image enlargements may result in reduced quality or sharpness, andthat colors on the final product may vary slightly from those shown on screen.

  • We may make minor technical edits (such as red-eye removal or brightness adjustments) to optimize your image for production.

You must not upload or submit any content that:

  • Is pornographic, violent, obscene, defamatory, hateful, or discriminatory
  • Infringes any third party’s copyright, trademark, or other intellectual property rights
  • Depicts illegal activity or violates any applicable law
  • Violates the privacy of any individual, including using names, addresses, or photos without consent
  • Harasses, embarrasses, or harms any person or group

We reserve the right to refuse production, delete, or block any content that violates these terms, with or without notice. We may also report unlawful content to relevant authorities. 

You are responsible for keeping backup copies of your files. We do not guarantee long-term storage or retrieval of any uploaded content.

By using our services, you agree to indemnify us and our employees against any claims, damages, or legal costs arising from the use of content you’ve provided.

We handle your content in accordance with applicable data protection laws.

8. Production of Products

Production times provided on the Site are estimates only and do not guarantee that products will be produced or shipped by a specific date. We strive to meet these timelines but delays can occur.

Due to the handmade and custom nature of our products, there may be slight variations in size compared to the dimensions stated on the website.

We reserve the right to substitute materials or modify product designs at our discretion to accommodate availability, supply, or production needs.

9. Returns

All our products are custom-made to order and personalized according to your submitted design. For this reason, they are not eligible for return or cancellation once production has started.

In accordance with applicable consumer protection laws, you have the right to submit a complaint about a defective or faulty product within 14 days of receiving your order. If you believe your item has a manufacturing defect (e.g. printing issue, stitching fault, material damage), please contact us within 14 days of delivery, including clear photos and a description of the problem.

If we confirm a production error, we will repair or replace the item free of charge. We reserve the right to determine whether a defect qualifies as a manufacturing fault.
Important: In order for a claim to be eligible, the product must be returned or documented in its original state (e.g. uncut fabric, unwashed garments, or unaltered products). Claims related to materials that have already been adjusted, sewn, printed over, or otherwise modified by the customer or third party will not be accepted. Please inspect all items upon delivery and before beginning any production.

All complaints must be submitted by email to info@caspar-design.com, referencing your order number.

10. Dropshipping Partners

If you are using our services as a dropshipping partner, you agree to:

  • Clearly communicate production and delivery times to your own customers

  • Provide accurate and complete order information to avoid delays

  • Take full responsibility for any claims or customer service related to your own end customers

We do not communicate with your customers directly. Any legal or consumer rights claims made by your end customers are your responsibility. We are your production partner and will support you in resolving any manufacturing or delivery issues covered by our terms.

 11. Delivery

Delivery times are provided based on current information and are given in good faith. In most cases, products arrive within the estimated timeframe, but we cannot guarantee delivery on a specific date. Delays may occur due to circumstances beyond our control, such as courier delays or customs clearance.

Orders shipped outside the European Union may be subject to additional customs duties, import taxes, or local handling fees. These charges are not included in the product or shipping price and are the responsibility of the recipient. We are not liable for these costs and cannot reimburse them.

Once your order has been produced and dispatched, you will receive an email with a tracking link to follow your shipment.

12. Termination

We reserve the right to cancel or terminate any order at our sole discretion and without prior notice. In such cases, we will issue a full refund for any payments received, unless production has already started.

We may also suspend or discontinue our services at any time. If this occurs, we are not responsible for any business investments made by users relying on our service, such as marketing campaigns, photoshoots, or customer pre-orders. Any additional support or resolution offered in such cases will be considered a gesture of goodwill and not a legal obligation.

13. Website Access, Feedback & Operation

Account Access
If you create an account on our website, you are responsible for keeping your login details secure. Do not share your password with others. We are not liable for any loss or damage resulting from unauthorized access due to failure to keep your login information safe. We may revoke access to your account or restrict certain features at our discretion, without prior notice.

Website Changes and Availability
We may change the layout, content, or features of the website at any time, or suspend access temporarily (e.g. for maintenance or updates). We are not responsible for any losses caused by downtime or website changes. You are responsible for keeping backups of any content or images you upload.

Customer Feedback and Testimonials
If you send us feedback, reviews, or photos of finished products, you allow us to use that content for promotional purposes. This includes publishing it on our website, social media, or marketing materials. We may shorten the content and will include your first name and last name or business name, unless you give permission otherwise.

14. Sellers and Drop-shippers

If you use our platform to create and sell products, or if you connect your store to another online platform, here’s what you need to know:

  • You’re responsible for all products and content you upload to our site or linked platforms.

  • If you sell through third-party websites connected via our service, you also handle customer support for your buyers.

  • We review your store’s content before publishing and reserve the right to edit or remove anything that doesn’t follow our rules — without prior notice.

  • If you use our API or other tools to connect with external platforms, we’re only responsible for our part of the service.

  • Sales commissions are calculated after deducting taxes, customs fees, and administrative costs.

This helps us keep a safe and reliable community for sellers and buyers alike.

15. Indemnity

You agree to protect and hold harmless our company, including its employees, directors, agents, and partners, from any claims, damages, losses, or expenses arising from your violation of these terms, applicable laws, or the rights of any third party. This includes covering any reasonable legal fees or costs incurred due to such claims.

16. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or products.

Our liability is limited to the purchase price of the item you ordered, except in cases of gross negligence or legal obligations.

17. External Links

Our website may contain links to third-party websites. We are not responsible for the content or privacy practices of those sites. Use them at your own risk.

18. Privacy

Your use of our website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

19. Governing Law and Jurisdiction

We strive to be reasonable and fair in our approach. Should any dispute arise, we will first seek to resolve it through discussion and dialogue for a speedy resolution. If that fails, we will attempt arbitration and alternative dispute resolution methods.

If all reasonable resolution efforts are exhausted within a reasonable time frame, these Terms and any provision of goods and services by us shall be governed by and construed in accordance with the laws of the Republic of Croatia.

Any disputes arising in relation to these Terms or to the provision of goods and services by us shall be subject to the exclusive jurisdiction of the courts of the Republic of Croatia.

We may update these Terms of Use, pricing, service descriptions, or website content at any time. Changes will take effect once published on this page.
